Q: Are there any limits to confidentiality?
A: While confidentiality is a cornerstone of therapy, there are certain situations where it must be breached. These exceptions are in place to protect the client or others from harm and are legally mandated. The main limits to confidentiality include:

  • Threats of Harm to Self - If a client expresses a serious intent to harm themselves (e.g., suicidal thoughts or plans), the psychologist may need to take steps to ensure the client’s safety. This could include notifying emergency contacts, involving mental health crisis services, or contacting the police.

  • Threats of Harm to Others - If a client threatens to harm another person, the psychologist may be required to warn the potential victim and/or notify law enforcement to prevent the harm.

  • Child or Elder Abuse - Psychologists are mandated reporters, meaning they are legally required to report any suspected abuse or neglect of children, elders, or vulnerable adults to the appropriate authorities.

  • Court Orders - In some legal situations, a psychologist may be compelled by a court order to release client records or provide testimony. However, efforts are often made to protect as much of the client’s privacy as possible.

  • Supervision and Consultation - Sometimes, therapists may discuss cases with supervisors or colleagues to receive guidance or consultation. When this occurs, identifying details are typically omitted to maintain client anonymity.

A: Clients are informed of these confidentiality limits during their initial sessions, often in a written document known as an "informed consent" form. This document outlines the scope of confidentiality and the specific circumstances under which it may be broken. Understanding the limits of confidentiality is crucial for clients so they can make informed decisions about what they share in therapy. It also ensures that they are aware of the protections in place and the responsibilities of their psychologist.
